Legal expert Munir A. Malik has said that Syed Mansoor Ali Shah will be the Constitutional Chief Justice of Pakistan on October 26, and Faiz Isa will be the Chief Justice till October 25.
Munir A. Malik while speaking in the program of ARY News said that Qazi Faiz Isa is my Chief Justice of Pakistan till October 25.
Syed Mansoor will be the Constitutional Chief Justice on October 26, everyone knows that the senior judge will become the Chief Justice of Pakistan.
The legal expert said that the Chief Justice should be based on seniority so that no one has a monopoly.
Munir A. Malik said that the Constitution cannot be nullified and the basic structure cannot be changed, Malik Asad Ali’s case judgment was included in the Eighteenth Amendment as a principle.
He said that the Parliament has limited power, it cannot abolish the court, and the constitution is not an agreement between the parties, the constitution is an agreement between the people of Pakistan.
If people don’t know what is being tied to, then nothing happened, Parliament has no right to punish or prosecute me or anyone else.
Legal expert Munir A. Malik further said that the judiciary does not have the power to make laws, it can only decide according to the law.
It is also worth mentioning that till evening, the government and JUI could not settle the issues regarding the constitutional amendments, while Maulana Fazlur Rehman has been contacted by PTI.
More than 20 clauses have been included in the proposed constitutional amendments, while clauses 51, 63, 175, 187, and others will be amended.
According to the proposed constitutional amendments, the tenure of the Chief Justice of Pakistan will not be extended and the judge will be appointed from the panel of 5 senior judges of the Supreme Court. The government will appoint the Chief Justice of Pakistan from among the 5 senior judges of the Supreme Court.
It further stated that the appeal on the decision of the Constitutional Court will be heard in the Constitutional Court, the petitions related to Articles 184, 185, and 186 will be heard in the Constitutional Court, while there is a possibility that Article 181 of the Constitution will also be amended.
Earlier, government sources had claimed that Maulana Fazlur Rehman’s reservations have been cleared, Fazlur Rehman will support the government regarding the constitutional amendment.
Government sources said that the constitutional amendment is a comprehensive package in which a constitutional court will be created, and the procedure for appointing judges for the constitutional court is also being devised.
Sources said that the purpose of creating a constitutional court is to provide relief to common citizens, Bilawal Bhutto and Maulana Fazlur Rehman have resolved the controversial issues, now the constitutional amendment is likely to be presented in both houses today.
The government members claimed that the number of government members in the National Assembly, and Senate is complete, amendments are also being made regarding the vote of dissenting members, and the draft is ready to amend Article 63 A of the Constitution.
It has also been claimed by government sources that the number game for constitutional amendments has been completed in the Senate as well.
