Senior Supreme Court judges Justice Mansoor Ali Shah and Justice Athar Minallah have resigned following the approval of the 27th Constitutional Amendment.
In his 13-page resignation letter to the President, Justice Mansoor Ali Shah stated that the 27th Amendment is a serious attack on the Constitution of Pakistan and has fragmented the Supreme Court. He said the amendment has brought the judiciary under the control of the government, striking a severe blow to the spirit of constitutional democracy.
Justice Mansoor Ali Shah added that dividing the country’s highest court has undermined judicial independence, making justice inaccessible to ordinary citizens and leaving the weak powerless before the powerful. He concluded his resignation with verses by renowned poet Ahmed Faraz and expressed gratitude to his family, friends, and staff, emphasizing that he is resigning with full responsibility and a clear conscience.
Similarly, Justice Athar Minallah also submitted his resignation to the President. In his letter, he noted that he had previously expressed concerns to the Chief Justice of Pakistan about the proposed provisions of the amendment and their potential impact on the constitutional system. Justice Athar Minallah prayed that all decisions be made truthfully.
According to sources, following the approval of the 27th Amendment, a Constitutional Court will be established, with Justice Aminuddin Khan set to serve as its Chief Justice. Both Justice Mansoor Ali Shah and Justice Athar Minallah had earlier sent letters to Chief Justice Yahya Khan Afridi outlining their concerns.
