Islamabad: After the approval of the President of Pakistan Asif Ali Zardari, the gazette notification of the 26th constitutional amendment was issued.
According to the details, the gazette notification of the 26th Constitutional Amendment was issued by the National Assembly after which the 26th Constitutional Amendment Bill 2024 became an Act of Parliament.
The 26th constitutional amendment came into effect after the gazette notification was issued.
After the 26th constitutional amendment, the first special parliamentary committee will be constituted to appoint the new Chief Justice of Pakistan. Under clause 3 of Article 175A, the appointment of the new Chief Justice will be implemented.
The Chief Justice of Pakistan will send the names of three senior judges to the Parliamentary Committee under sub-clause three of Article 175A and the Parliamentary Committee will appoint one of the three judges.
The Special Parliamentary Committee will appoint the Chief Justice of Pakistan and send the name to the Prime Minister, who will then send the advice for the appointment of the Chief Justice to the President.
The Special Parliamentary Committee constituted under sub-clause 3A of Article 175A shall consist of 12 members. Eight members will be chosen from the National Assembly and four from the Senate.
Under sub-clause 3C of Article 175A, the Chief Justice of Pakistan will send a panel of three senior judges to the Parliamentary Committee three days before retirement. The Speaker of the National Assembly will form a special parliamentary committee.
It should be noted that yesterday the 26th constitutional amendment was approved by the Senate and the National Assembly by majority vote.
